Terms and Conditions

These Terms and Conditions ("Terms") govern access to and use of the downloadable IP Geolocation database ("Database"), distributed via this website (the "Site") by Cloud66, Inc. and its affiliates ("Cloud66," "we," "us," or "our"). By downloading, copying, using, or otherwise interacting with the Database, you ("you," "your," "User") agree to these Terms. If you do not agree with these Terms, do not access or use the Database.

1. Database License

1.1 Creative Commons Attribution 4.0

The Database is licensed under the Creative Commons Attribution 4.0 International License (CC BY 4.0).

Under this license, you are free to:

• Share — copy and redistribute the Database in any medium or format for any purpose, including commercially.
• Adapt — remix, transform, and build upon the Database for any purpose, including commercially.

1.2 Attribution Requirement

Under CC BY 4.0, you must give appropriate credit, provide a link to the license, and indicate if changes were made. You may do so in any reasonable manner, but not in any way that suggests Cloud66 endorses you or your use.

Examples of acceptable attribution include (without limitation):

"IP Geolocation data provided by Cloud66 — https://ip66.dev — Licensed under CC BY 4.0"

"Contains Cloud66 IP Geolocation database (CC BY 4.0) — https://ip66.dev"

1.3 No Additional Restrictions

You may not apply legal terms or technological measures that legally restrict others from doing anything the CC BY 4.0 license permits.

2. Third-Party Data and License Compliance

2.1 GeoNames Data

Portions of the Database are derived from the GeoNames geographical database, which is also licensed under the Creative Commons Attribution 4.0 International License (CC BY 4.0).

You acknowledge and agree that:

1. GeoNames data is provided under the CC BY 4.0 license, which requires appropriate credit, a link to the GeoNames source (e.g., https://www.geonames.org/), and a link to the CC BY 4.0 license;
2. You must provide such GeoNames attribution when redistributing or using the derived portions of the Database; and
3. You must indicate if changes were made to the original GeoNames data in accordance with CC BY 4.0.

An example of acceptable GeoNames attribution is:

"Contains geographic data derived from GeoNames, licensed under Creative Commons Attribution 4.0 International License (CC BY 4.0). GeoNames available at https://www.geonames.org/."

3. Source Code Licensing

All source code made available by Cloud66 for generating or processing the Database is licensed under the Apache License, Version 2.0. The Apache 2.0 license applies only to the source code and does not govern the Database itself except as specified in these Terms.

4. No Endorsement or Affiliation

4.1 MaxMind

This Database project and related materials are not endorsed by, affiliated with, authorized by, or sponsored by MaxMind, Inc. Any reference to MaxMind or the "MaxMind DB format" is used solely for descriptive compatibility purposes and does not imply endorsement or partnership.

4.2 No Third-Party Endorsements

Nothing in these Terms, attribution notices, or other materials shall be construed to imply sponsorship, endorsement, or affiliation between Cloud66 and any third-party data provider beyond the attribution required by their respective licenses.

5. Data Quality and Accuracy

The Database is provided for general informational purposes only. Cloud66 does not guarantee the accuracy, completeness, correctness, reliability, or usefulness of any Database content. You acknowledge that:

1. IP Geolocation and geographic data are inherently imprecise;
2. The Database and any derived data may contain errors, omissions, inaccuracies, or outdated information; and
3. Cloud66 is under no obligation to update, correct, or maintain the Database.

6. Availability of the Site and Database

You access and use the Database at your own risk. Cloud66 does not warrant that access to the Site or the Database will be uninterrupted, secure, timely, or error-free. Cloud66 may modify, suspend, or discontinue any aspect of the Database or Site at any time without notice.

7. Disclaimer of Warranties

To the extent not prohibited by the CC BY 4.0 license, the Database is provided "AS IS," "AS AVAILABLE," and WITHOUT WARRANTY OF ANY KIND, whether express, implied, statutory, or otherwise, including but not limited to:

• any implied warranties of merchantability;
• fitness for a particular purpose;
• non-infringement;
• accuracy, availability, or completeness of the data.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Cloud66 and its officers, directors, employees, agents, affiliates, successors, and assigns shall not be liable for:

1. any direct, indirect, incidental, consequential, special, punitive, or exemplary damages;
2. loss of profits, revenue, data, goodwill, or business interruption;
3. claims by third parties including arising from your use of the Database;
4. errors, inaccuracies, or reliance on the Database; or
5. any damage or loss arising from your inability to use or access the Database or Site.

This limitation applies regardless of the legal theory (contract, tort, strict liability, etc.), even if Cloud66 has been advised of the possibility of such damages.

9. Fair Use and Acceptable Use

9.1 Fair Use Policy

The Database is made available for legitimate purposes including application development, research, analytics, and network administration. You agree to use the Site in a fair and reasonable manner and not to engage in any activity that places an unreasonable or disproportionate burden on the Site or its infrastructure.

Without limiting the foregoing, the following activities are prohibited:

1. excessive automated downloads or repeated bulk retrieval of the Database beyond what is reasonably necessary to maintain an up-to-date copy;
2. using the Site in a manner that disrupts, degrades, or impairs the availability or performance of the Site for other users;
3. attempting to circumvent any access controls, rate limits, or technical measures implemented by Cloud66; and
4. using the Database for any unlawful purpose, including but not limited to activities that violate applicable data protection, privacy, or export control laws.

9.2 Right to Restrict Access

Cloud66 reserves the right, at its sole discretion and without prior notice, to:

1. block, restrict, suspend, or terminate access to the Site for any User who engages in activity that Cloud66 reasonably determines to be abusive, fraudulent, or harmful;
2. implement rate limiting, IP blocking, or other technical measures to enforce this fair use policy; and
3. take any other action Cloud66 deems necessary to protect the integrity, availability, and security of the Site.

For the avoidance of doubt, restricting access to the Site does not revoke or limit any rights granted under the CC BY 4.0 license for copies of the Database you have already obtained.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California (excluding its conflicts of law principles). Disputes shall be resolved exclusively in the state or federal courts located in San Francisco County, California.

11. Miscellaneous

11.1 Entire Agreement

These Terms, together with the CC BY 4.0 license, constitute the entire agreement between you and Cloud66 regarding the Database.

11.2 Amendments

Cloud66 may update these Terms at any time by posting a revised version on the Site. Continued use of the Site after posting indicates acceptance of the revised Terms. Any changes to these Terms do not affect or revoke rights already granted under the CC BY 4.0 license for copies of the Database previously obtained.

11.3 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
